Terms and Conditions (T&C)

These Terms and Conditions (hereinafter referred to as T&C) regulate the conclusion, content and execution of contracts between enjoytrade naglieri (hereinafter referred to as enjoymedia.ch) and its customers (hereinafter referred to as the customer) in connection with the sale of goods via the webshop enjoymedia.ch.

The presentation of products on enjoymedia.ch is an offer and represents a non-binding offer. By clicking the "Order" button, you place a binding order for the goods contained in the shopping cart. We confirm receipt of your order immediately after the order process by an automated e-mail. Your order is accepted with the invoice or the payment confirmation, at the latest when the ordered goods are dispatched. The purchase contract is thereby concluded.

Product images are for illustration purposes. Minor differences in colour, size and design, for example due to screen settings or the manufacturer's production batches, are reserved. Decorations and accessories shown in the images are only included in the delivery if they are mentioned in the product description. Some lifestyle and mood images have been created or edited with the help of artificial intelligence (AI); for the products concerned, we point this out in the product description. The product description is binding for the design and scope of delivery.

The prices of products and services from enjoymedia.ch are gross in Swiss Francs (CHF), including Swiss VAT. The price shown in the online shop at the time of ordering is decisive. Subject to errors, technical errors, spelling and printing errors. Enjoymedia.ch also reserves the right to change prices at any time.

Additional costs, such as costs for packaging and shipping/delivery (freight/transport) are not included in the prices. Freight costs are charged separately during the order process.

enjoymedia.ch can only deliver individual goods while stocks last. enjoymedia.ch is entitled to make partial deliveries. Subsequent deliveries are made immediately after the goods arrive in stock. All information on delivery times and availability is without guarantee and can be changed subsequently by enjoymedia.ch.

In the event of delivery disruptions due to circumstances beyond enjoymedia.ch's control, such as strike, lockout, material failure, transport or operational ban at the manufacturer, lack of delivery readiness of our suppliers or transport problems, enjoymedia.ch is entitled to cancel confirmed orders. In the event of a delivery disruption on the part of enjoymedia.ch, the customer can withdraw from the contract 30 calendar days after the originally stated delivery date (pre-orders of products identified as such on enjoymedia.ch are excluded).

The customer undertakes to check the delivery address and his email address during the order process. Costs arising from the fact that the delivery address was incorrectly or insufficiently provided (undeliverability) are borne by the customer. Costs arising from the fact that the customer does not accept the goods or, in the case of not being at home, does not collect the goods from the shipping service provider, are borne by the customer. In all three cases, the customer is entitled to a refund of any purchase price payment made; further claims are excluded.

Goods are delivered exclusively to Switzerland and Liechtenstein.

Shipping is at the customer's risk. The customer has the obligation to immediately check the delivered goods for completeness, correctness and delivery damage. The customer must notify enjoymedia.ch in writing of damaged, incorrect or incomplete deliveries immediately upon discovery.

In Switzerland and Liechtenstein there is no statutory right of withdrawal for online purchases. However, enjoymedia.ch voluntarily grants the customer a right of return of 30 days from receipt of the goods. The details (condition of the goods, procedure, costs and excluded items) are set out in Section 6. The statutory warranty rights for defective goods (Section 8) remain unaffected.

Goods may only be returned to enjoytrade Naglieri, Nidfeldstrasse 1, 6010 Kriens, Switzerland.

The voluntary right of return is 30 days from receipt of the goods; the shipping date of the return (postmark) is decisive. The goods must be returned in their original packaging, unopened, unused and complete, with the delivery note enclosed. Risk and costs of return are borne by the customer; no handling fee is charged. Unpaid parcels will not be accepted.

After receipt of the goods, an inspection is carried out. If the return conditions have been met and the goods are unused and not damaged and their packaging is intact and unopened, the purchase price excluding shipping costs will be refunded, otherwise the goods will be fully invoiced to the customer.

The following products are, in particular, excluded from the voluntary right of return:

• Personalized products specified at the customer's request
• Greeting cards with a printed message, gift wrapping and other gift extras added to an order; their price is not refunded, even if the rest of the order is returned
• Gift vouchers (see Section 10)
• Items whose expiry date has passed (especially food, cosmetics and perfume)
• Items with damaged packaging
• Items which, for hygienic reasons and due to health protection, are not suitable for return and whose seal has been removed after delivery (e.g. sex toys and fresh food)
• Cosmetics, personal-care, hygiene and food items, as well as pet food (for hygiene reasons)
• Utensils for body, hair, nail and oral care, e.g. brushes, make-up brushes, sleep masks, face rollers, manicure and shaving accessories (for hygiene reasons)
• Books delivered shrink-wrapped (except colouring and activity books)
• Calendars, audio, video and data carriers as well as colouring and activity books whose protective film or seal has been removed after delivery
• Items marked as excluded from return on the respective product page or in the return form in the customer account

Defective products should, where possible, be kept in their original packaging. The above exclusions apply only to the voluntary right of return; the statutory warranty rights for defective or incorrectly delivered goods (Section 8) remain unaffected. In justified cases of defect or incorrect delivery, enjoymedia.ch bears the return costs.

The customer can choose between the following payment methods: invoice (Switzerland and Liechtenstein), credit/debit card (Visa, Mastercard, American Express), PayPal, TWINT, PostFinance Pay and prepayment.

When purchasing with a credit/debit card, TWINT or PostFinance Pay, the charge is made at the end of the order.

When purchasing via PayPal, the charge is made according to PayPal's T&C. By confirming the order, the customer agrees to this.

We deliver on invoice to companies and organizations registered in the Swiss or Liechtenstein commercial register as well as private individuals resident in Switzerland or Liechtenstein. The invoice becomes due within 14 days of invoicing.

Invoices and reminders are sent by enjoymedia.ch by email. The customer must ensure that he has provided the correct email address during the order process. All consequential costs arising from the provision of an incorrect email address (reminders, collection fees, etc.) are borne by the customer. In case of payment delay, reminder fees may be charged (2nd reminder CHF 5, 3rd reminder CHF 15). In case of payment delay, enjoymedia.ch is also entitled to assign the claim at the debtor's expense to infoscore Inkasso AG.

If we provide advance payment, we may obtain credit information based on mathematical-statistical procedures from CRIF AG, Hagenholzstrasse 81, 8050 Zurich, to protect our legitimate interests. Your interests worthy of protection are taken into account in accordance with legal provisions. No disclosure to other third parties takes place. In the event of negative credit information, the customer cannot order and pay on invoice.

If a customer is in arrears with the payment of an open invoice and a prepayment of a new order is received in our account, enjoymedia.ch will use this prepayment to settle the open invoice(s).

The responsibility for the selection, configuration, use and use of products, as well as the results achieved with them, lies with the customer or the recipient of the products, i.e. the end customer. The customer acknowledges that enjoymedia.ch does not carry out incoming inspections of products delivered by manufacturers or suppliers.

If the delivery is incomplete, enjoymedia.ch will deliver the missing items as soon as possible. The voluntary right of return for goods in perfect condition is governed by the conditions in Section 6.

Towards consumers, the statutory warranty rights under the Swiss Code of Obligations (Art. 197 et seq. CO) apply. The limitation period is two years from receipt of the goods (one year for used items) and is not reduced towards consumers. Defects must be reported immediately upon discovery (Art. 201 CO). In the case of a justified defect, the customer is entitled, in accordance with the law, to rectification, replacement, price reduction or rescission; the shipping and return costs associated with a justified notice of defect are borne by enjoymedia.ch.

Any factory or manufacturer's guarantee applies in addition to the statutory warranty and can be asserted directly with the manufacturer or the agencies designated by them. Otherwise, enjoymedia.ch is liable only to the extent legally required; any further liability, in particular for indirect or consequential damages, is excluded to the extent permitted by law.

Alcoholic beverages may not be sold to young people under 16 years of age in Switzerland and Liechtenstein due to legal regulations, and spirits may not be sold to young people under 18 years of age. When ordering alcoholic beverages and spirits, the customer acknowledges these regulations and confirms that he is entitled to purchase based on his age.

Gift vouchers are available with a value of CHF 10, CHF 20 and CHF 50. When purchasing, you choose delivery by e-mail or by post. By e-mail, you receive the voucher code in a separate e-mail to the e-mail address provided with the order as soon as payment has been received. By post, we print the voucher and send it to you free of charge.

A gift voucher is valid for three years from the date of purchase; the expiry date is shown on the voucher. It can be redeemed for the entire range in the webshop enjoymedia.ch and can only be redeemed once. If the value of the goods in the order is lower than the voucher value, the remaining amount is forfeited. No remaining balance is issued and the voucher is not paid out in cash.

Gift vouchers cannot be paid for with a gift voucher. Discount and promotional codes cannot be redeemed for the purchase of gift vouchers. If an order contains a gift voucher, the payment methods invoice and prepayment are not available.

Gift vouchers are excluded from the voluntary right of return (Section 6). If the order with which a gift voucher was purchased is cancelled or the purchase price of the voucher is refunded, the voucher code becomes invalid.

These provisions apply to gift vouchers purchased from October 17, 2026. Gift vouchers purchased earlier remain subject to the conditions that applied at the time of purchase.

The scope and purpose, as well as the type of collection, use and processing of personal data required for the order process by enjoymedia.ch is described in detail in our privacy policy. This is an integral part of these T&C. By accepting our T&C, the customer also agrees to our privacy policy.

12.1. The delivered products remain the property of enjoymedia.ch until full payment.

12.2. enjoymedia.ch can change these Terms and Conditions at any time. However, the version of these T&C valid at the time of ordering is decisive.

12.3. Should one or more of these provisions be void or ineffective, the binding nature of the other provisions remains unaffected. enjoymedia.ch replaces the void or ineffective provisions with economically equivalent lawful provisions. The same applies to filling any contractual gaps.

12.4. These Terms and Conditions are written in German, French, Italian and English. In case of contradictions, the German version is authoritative.

12.5. The place of jurisdiction for all disputes arising directly or indirectly from the contractual relationships is in Lucerne. enjoymedia.ch is entitled to sue the customer also at his ordinary place of jurisdiction.

12.6. The individual contracts as well as the T&C are subject exclusively to Swiss law with the express exclusion of state treaty norms, in particular the Vienna Convention on Contracts for the International Sale of Goods, international private law and the UN Convention on Contracts for the International Sale of Goods (CISG).
