Terms and Conditions (T&C)

1. Scope
These Terms and Conditions (hereinafter referred to as T&C) regulate the conclusion, content and execution of contracts between enjoytrade naglieri (hereinafter referred to as enjoymedia.ch) and its customers (hereinafter referred to as the customer) in connection with the sale of goods via the webshop enjoymedia.ch.
2. Contract conclusion
The presentation of products on enjoymedia.ch is an offer and represents a non-binding offer. By clicking the "Order" button, you place a binding order for the goods contained in the shopping cart. The confirmation of receipt of your order takes place together with the acceptance of the order immediately after the order process by an automated e-mail. With the sending of the shipping confirmation by e-mail, at the latest after the dispatch of the ordered goods, the purchase contract is concluded.
3. Prices
The prices of products and services from enjoymedia.ch are net in Swiss Francs (CHF) and EURO (EUR), including Swiss VAT. The price shown in the online shop at the time of ordering is decisive. Subject to errors, technical errors, spelling and printing errors. Enjoymedia.ch also reserves the right to change prices at any time.
Additional costs, such as costs for packaging and shipping/delivery (freight/transport) are not included in the prices. Freight costs are charged separately during the order process.
Customers from the EU may incur costs during customs clearance (e.g. additional VAT payments, customs and storage fees). The obligation to inform oneself about the customs and import regulations of the country to which the order is to be shipped lies with the customer. All customs clearance costs are borne by the customer.
4. Delivery of ordered goods
enjoymedia.ch can only deliver individual goods while stocks last. enjoymedia.ch is entitled to make partial deliveries. Subsequent deliveries are made immediately after the goods arrive in stock. All information on delivery times and availability is without guarantee and can be changed subsequently by enjoymedia.ch.
In the event of delivery disruptions due to circumstances beyond enjoymedia.ch's control, such as strike, lockout, material failure, transport or operational ban at the manufacturer, lack of delivery readiness of our suppliers or transport problems, enjoymedia.ch is entitled to cancel confirmed orders. In the event of a delivery disruption on the part of enjoymedia.ch, the customer can withdraw from the contract 30 calendar days after the originally stated delivery date (pre-orders of products identified as such on enjoymedia.ch are excluded).
The customer undertakes to check the delivery address and his email address during the order process. Costs arising from the fact that the delivery address was incorrectly or insufficiently provided (undeliverability) are borne by the customer. Costs arising from the fact that the customer does not accept the goods or, in the case of not being at home, does not collect the goods from the shipping service provider, are borne by the customer. In all three cases, the customer is entitled to a refund of any purchase price payment made; further claims are excluded.
Goods are delivered to Switzerland, Liechtenstein and EU countries. enjoymedia.ch does not deliver to packstations in EU countries. Customers from the EU undertake not to provide packstations as a delivery address during the order process.
Shipping is at the customer's risk. The customer has the obligation to immediately check the delivered goods for completeness, correctness and delivery damage. The customer must notify enjoymedia.ch in writing of damaged, incorrect or incomplete deliveries within 5 calendar days of receiving the goods.
5. Right of withdrawal
The customer has the right to revoke his order in writing (email or letter) within 7 days of receiving the goods.
Withdrawal instructions
The contractual declaration can be revoked by the customer within two weeks without giving reasons in text form (email or letter) or - if the item is handed over to you before the deadline expires - by returning the item. The period begins after receipt of these instructions in text form, but not before receipt of the goods by the recipient (in the case of recurring delivery of similar goods not before receipt of the first partial delivery) and also not before fulfillment of our information obligations according to § 312c para. 2 BGB in conjunction with § 1 para. 1, 2 and 4 BGB-InfoV as well as our obligations according to § 312e para. 1 sentence 1 BGB in conjunction with § 3 BGB-InfoV. To comply with the withdrawal period, it is sufficient to send the withdrawal or the item in good time.

Withdrawal consequences
In the event of an effective withdrawal, the services received by both parties must be returned and any benefits drawn (e.g. interest) must be surrendered. If you cannot return the service received in whole or in part or only in a deteriorated condition, you may have to pay us compensation for value to that extent. This does not apply to the handover of goods if the deterioration of the goods is due exclusively to their examination - as would have been possible for you in a shop, for example. Otherwise, you can avoid the obligation to pay compensation for value for a deterioration resulting from the intended use of the item by not taking the item into use as your property and refraining from anything that impairs its value. Items that can be sent by parcel are to be returned at our risk. You must bear the costs of return if the delivered goods correspond to those ordered. Items that cannot be sent by parcel will be collected from you. Obligations to refund payments must be fulfilled within 30 days. The period begins for you with the dispatch of your withdrawal declaration or the item, for us with its receipt.

6. Return of ordered goods
Goods may only be returned to enjoytrade Naglieri, Nidfeldstrasse 1, 6010 Kriens, Switzerland.
The return of goods must be made within 14 calendar days from the date of notification of the return, in original packaging, unopened, complete and with enclosure of the delivery note/warranty certificate. Risk and costs of return are borne by the customer.
After receipt of the goods, an inspection is carried out. If the return conditions have been met and the goods are unused and not damaged and their packaging is intact and unopened, the purchase price excluding shipping costs will be refunded, otherwise the goods will be fully invoiced to the customer.
No right of return is generally granted for the following products:
- Personalized products specified at the customer's request
- Items whose expiry date has passed (especially food, cosmetics and perfume)
- Items with damaged packaging
- Items which, for hygienic reasons and due to health protection, are not suitable for return and whose seal has been removed after delivery (e.g. sex toys and fresh food)
Defective products must be kept in their original packaging.
7. Payment
The customer can basically choose between payment with Postcard (Switzerland and Liechtenstein only) or credit card/PayPal (Visa, Eurocard/Mastercard/Amex etc.), prepayment, PostePay (Italy only) and on invoice (Switzerland only).
When purchasing with a credit card (VISA, Master Card and AMEX) or PostFinance Card, the charge is made at the end of the order.
When purchasing via PayPal, the charge is made according to PayPal's T&C. By confirming the order, the customer agrees to this.
We deliver on invoice to companies and organizations registered in the Swiss commercial register as well as private individuals resident in Switzerland. The invoice becomes due within 14 days of invoicing.
Invoices and reminders are sent by enjoymedia.ch by email. The customer must ensure that he has provided the correct email address during the order process. All consequential costs arising from the provision of an incorrect email address (reminders, collection fees, etc.) are borne by the customer. In case of payment delay, reminder fees may be charged (2nd reminder CHF 5, 3rd reminder CHF 15). In case of payment delay, enjoymedia.ch is also entitled to assign the claim at the debtor's expense to infoscore Inkasso AG.
If we provide advance payment, we may obtain credit information based on mathematical-statistical procedures from CRIF AG, Hagenholzstrasse 81, 8050 Zurich, to protect our legitimate interests. Your interests worthy of protection are taken into account in accordance with legal provisions. No disclosure to other third parties takes place. In the event of negative credit information, the customer cannot order and pay on invoice.
If a customer is in arrears with the payment of an open invoice and a prepayment of a new order is received in our account, enjoymedia.ch will use this prepayment to settle the open invoice(s).
8. Warranty and liability
The responsibility for the selection, configuration, use and use of products, as well as the results achieved with them, lies with the customer or the recipient of the products, i.e. the end customer. The customer acknowledges that enjoymedia.ch does not carry out incoming inspections of products delivered by manufacturers or suppliers.
If the delivery is incomplete, enjoymedia.ch will deliver as soon as possible. A complaint about the delivery for any reason does not release the customer from paying the invoice within the payment period agreed with enjoymedia.ch. If the customer exceptionally has a right of return, for example due to a specific agreement with enjoymedia.ch, the customer only has a right to a refund of the purchase price if and only if the products have arrived at enjoymedia.ch in their original packaging and in a resalable condition.
enjoymedia.ch does not provide any warranty for the products it delivers. The customer is only entitled to any factory warranty from the manufacturer, which must be asserted directly with them or with the agencies designated by them. The customer can also demand from enjoymedia.ch the assignment of any warranty claims to which it may be entitled against third parties, such claims being asserted by the customer at his own expense and risk. Further claims by the customer are excluded.
The customer acknowledges that, based on the applicable warranty conditions of the manufacturer, the warranty is generally limited, at the choice of the respective manufacturer/supplier, to rectification or replacement of defective/faulty products and that no repair attempts by third parties have taken place.
9. Youth protection
Alcoholic beverages may not be sold to young people under 16 years of age within Switzerland and the EU due to legal regulations, and spirits may not be sold to young people under 18 years of age. When ordering alcoholic beverages and spirits, the customer acknowledges these regulations and confirms that he is entitled to purchase based on his age.
10. Data protection
The scope and purpose, as well as the type of collection, use and processing of personal data required for the order process by enjoymedia.ch is described in detail in our privacy policy. This is an integral part of these T&C. By accepting our T&C, the customer also agrees to our privacy policy.
11. Final provisions
11.1. The delivered products remain the property of enjoymedia.ch until full payment.
11.2. enjoymedia.ch can change these Terms and Conditions at any time. However, the version of these T&C valid at the time of ordering is decisive.
11.3. Should one or more of these provisions be void or ineffective, the binding nature of the other provisions remains unaffected. enjoymedia.ch replaces the void or ineffective provisions with economically equivalent lawful provisions. The same applies to filling any contractual gaps.
11.4. These Terms and Conditions are written in German, French, Italian and English. In case of contradictions, the German version is authoritative.
11.5. The place of jurisdiction for all disputes arising directly or indirectly from the contractual relationships is in Lucerne. enjoymedia.ch is entitled to sue the customer also at his ordinary place of jurisdiction.
11.6. The individual contracts as well as the T&C are subject exclusively to Swiss law with the express exclusion of state treaty norms, in particular the Vienna Convention on Contracts for the International Sale of Goods, international private law and the UN Convention on Contracts for the International Sale of Goods (CISG).
